Chief F. O. Orbih, lawyer of Wike and the Democratic People's Party (PDP), had urged the court to bring an action against the lawsuit. However, the applicant's lawyer disputed the arguments on the ground that the application was ineligible.

According to the document in court, Wike had forged his birth certificate and lied to INEC to secure his appointment as governor of the PDP for the upcoming elections in Rivers State.

He further said that the Wike birth certificate attached to his Form CF001 was submitted to INEC, which was allegedly rejected by a Collins Nyeme Wike on October 3, 1986, and Nyesom Wike at the time of filing An application was made by Rumuepirikom in Obio / Akpor in the territory of the state of Rivers and that the said certificate was forged.
